Occupy Still Searching For Solution – Gazettes.com: News.

Tension remains between the Occupy Long Beach movement and the city after a report failed to satisfy the occupiers with its options or the methodology used to create it.
The City Manager’s Office released a report Nov. 30 to the City Council that gave several possibilities to consider regarding how to handle the occupiers moving forward:
• Maintain the current approach, which allows occupiers onto Lincoln Park during the day and forces them to the sidewalk at night.
• Allow occupiers to camp in El Dorado Regional Park Area II — the one park in the city where overnight camping is allowed now. This suggestion also may come with certain conditions that occupiers would have to follow based on the council’s discretion.
• Amend the overnight rule so that occupiers could stay in Lincoln Park, or any other park of the council’s choosing — again, likely with some conditions.
The report was given to City Council, but no item was put on the council agenda this week regarding it.
“Since we’re not on the agenda, the only opportunity is to bring it up during public comment,” said Chris Robson, Occupy Long Beach’s civic engagement committee liaison.
Members of Occupy Long Beach said they were frustrated that the City Manager’s Office did not speak with them before preparing the report to include their input — something Eighth District Councilwoman Rae Gabelich had directed weeks ago when the report was requested.
The options presented so far, Robson said, were still unacceptable — the City Council is being advised not to amend park rules.
“What we want is the ability to protest 24 hours a day and seven days a week at Lincoln Park,” he said. “Nothing has changed, but how do we get there within the rules of the city? Clearly, El Dorado Park doesn’t make any sense and the status quo doesn’t make any sense either.”
Gabelich said she believes that the Occupy Long Beach movement won’t be going away, so sol-
utions need to be looked at.
“Everyone has talked to me about not opening that door to changing the ordinance (for overnight camping at a park),” Gabelich said. “But maybe there is some way to just tweak it a little bit, because we do that all the time.”
Robson pointed out that Rose Park hours were changed for a special event within the last year — an approach that didn’t change the ordinance but was added as a separate rule.
After several occupiers spoke during the public comment portion of Tuesday’s City Council meeting, Gabelich attempted to address the issue, but was told it needed to be on the agenda.
Instead, she asked City Manager Patrick West to try again to work with the Occupy Long Beach movement.
“Mr. West I’m going to ask if you would work on that and engage the team for ongoing dialogue with the group to see how we can better serve their needs while still working within our ordinance,” she said.
On Wednesday, she confirmed that the City Manager’s Office will reach back out to occupiers and attempt to brainstorm more solutions moving forward.

LBPD Choke Protester Unconscious for Smoking

The police assaulted a new member this morning for smoking on the curb at the park. They choked him until he passed out and then took him away to the hospital. He was not fighting or doing anything more then sitting. When he put the cigarette out they jumped on him and started to choke him. They have also been telling some of the homeless that they need to leave the park and if they come back they will be arrested… FOR NO REASON! Ray Panek of the Quality of Life Unit with the LBPD is harassing and threating people. We need to be at the City Council to report on this and we need numbers for backup at the park. This occupation is just beginning it seems. (Jay)

George, new occupier and recently discharged vet, was sitting on the ledge at Lincoln Park, talking on phone and smoking a cigarette. Two bicycle officers approached and officer Dinsdale demanded George put out his cigarette. George replied “yes, 1 second” and put out his cigarette. George asked “Am I getting a ticket?”, then tried to end his phone call…

Before he could end the call, officer Dinsdale grabbed George’s arm and forcibly removed the phone. He then tackled George to the ground where both officers applied excess force grinding George’s face into the ground and dragging him onto the grass. Officer Dinsdale choked Goerge and violently punched him repeatedly while the other officer held him down with a knee in his back…

George clearly lost consciousness but for the 30 seconds after that point, the officer maintained the chokehold. Then the other officer placed the cuffs on George at which point Dinsdale released the chokehold allowing George’s head to hit the ground. George regained consciousness after 1 to 2 minutes during which Dinsdale repeatedly raised and dropped him. At this point, a spit guard was placed on George’s head and he was dragged to the awaiting patrol car…

The officers began to press down on George as they violently took him to the car. Visibly shaken, George pleaded “stop forcing me down, I will walk”. The Sergeant at the scene stated George was to be taken to the emergency room at St Mary’s. Several of us decided to try to see him at the hospital after an hour an a half but when we arrived at the emergency room, we were told by the staff that George had not come to the ER and no police had come there. We then went to the main lobby and were told that George had in fact been taken to the emergency. Eventually we were told that he had been released and taken to jail…

We then went to the police department to find out his status and we were told that he was being held on $25,000 bail. His charges were resisting arrest, obstructing a police officer, and smoking in the park. He clearly did not resist arrest or obstruct the officer in his duties. Additionally, we did not see any signs prohibited smoking and neither did we identify a municipal code prohibiting smoking in a park…

This is the latest and most brutal in a series of increasing harassment by the LBPD. On Saturday night they took 3 tables and several bins including our information, flyers, and literature because they claimed they were part of a temporary shelter. They have been giving citations to people for using a tarp to cover themselves or their belongings. They have told several homeless that they have too much stuff and would be arrested if they did not leave. Then yesterday in a similar incident another occupier and veteran, Nate, was arrested for smoking in the park. He refused to submit to a search at which point he was arrested…

OCCUPY LONG BEACH GIVEN ULTIMATUM

OLB told to clear park of stored items by Sunday night

November 26, 2011

About 3:30PM on Friday, November 25, LBPD South Division Watch Commander Lt J. Liberman and two other officers served verbal notice to Occupy Long Beach (“the occupiers”) that the group’s belongings (other than sleeping bags and blankets in use at the time) must be removed from the park and the sidewalk by this Sunday, November 27 at 10PM or they will be confiscated and “donated to the Rescue Mission.” When questioned about the reason, Lt Liberman, who would not give his business card to us, responded that there had been several complaints from neighbors and the public about the “eyesore” at Lincoln Park. The occupiers requested a written notice but were told by Lt. Liberman, “You don’t have a right to a written notice.”

The occupiers reminded Lt Liberman that at its last meeting the City Council had requested a report from the City Manager and City Attorney regarding the use of the park by OLB for exercise of our first amendment right to peaceful assembly, and to explore the City’s options to work cooperatively with OLB. They pointed out that this report was on the City Council Agenda for Tuesday, December 6, when a decision would be made. Lt Liberman said he was aware of this.

The occupiers expressed their surprise, then, that the LBPD – which is not a policy making body – would take this drastic action before the Tuesday decision of the City Council – which is the policy making body of Long Beach. The confiscation would dramatically change the policy worked about weeks ago between the Civic Engagement Committee of OLB and representatives of the offices of the City Manager, the City Attorney, Special Events, and the LBPD. This agreement included that if there were problems on either side they would meet to discuss it. Lt Liberman barked “I am not going to debate philosophy.”

He added that if the occupiers were dissatisfied they could call the City Attorney or they could take it up with City Council. They responded that his Sunday deadline prevented OLB from discussing the LBPD’s ultimatum and appeal with any of the City officials before the threatened confiscation. The officer’s response: “we’re just here to enforce the law.” Lt. Liberman repeated “We are bending over backwards to work with you” and similar phrases several times.
